Terms of use
In short: Waseni coordinates, it does not sell. The shop answers for its goods, the driver answers for their driving and their vehicle, and we answer for the order being documented so each side has its evidence when they disagree.
1. What Waseni is, and is not
Waseni is a platform that brings together a neighbourhood's shops and its drivers. The sale is directly between the shop and the customer, and the delivery is directly between the driver and the customer. We are not a seller, not a carrier, and not an agent for either.
2. Your account
- You must be eighteen or older.
- An account belongs to one person, and the phone number is its identity. You are responsible for what happens through your account.
- Registering as a shop or a driver requires our approval based on your verification photo. Approval can be withdrawn if the photo turns out not to reflect reality.
- The details you enter must be accurate, and you carry the consequences if they are not.
3. For customers
- Prices are set by the shop. The delivery fee is shown before you confirm.
- Payment is cash on delivery, unless stated otherwise in the app.
- You can cancel before the shop starts preparing. Once the driver has begun the run, some or all of the delivery fee may still be due.
- Being at the address at the agreed time is part of the deal. A delivery that fails because you were absent may still be charged.
4. For shops
- You are the seller. The goods, their condition, their safety, and their match to the description and photos are your responsibility.
- Photos you upload must be of your own goods, and you must have the right to use them.
- Licences and regulatory obligations for your trade — including anything concerning food — are yours alone.
- What may not be sold is in section 8.
5. For drivers
- You are an independent contractor, not our employee. You decide when you work and which runs you take, and we do not guarantee you a volume of work.
- Your vehicle and its roadworthiness, your driving, and anything the law requires of them are your responsibility. The plate number is optional with us; that does not relieve you of any legal obligation outside the app.
- Pickup and handover photos are part of the job: they are what protects you when someone says something never arrived.
- Cash you collect on a shop's behalf is held in trust until you hand it over.
6. Commercial disagreements between parties
A missing item, a late arrival, a damaged parcel, a replacement request, an agreed partial refund, an absent customer, a long wait — these are ordinary commercial disagreements, and we do not rule on them.
What we do instead: give both sides a channel to message each other, show them the stored photographic record of the order, let either side make a settlement offer and the other explicitly accept or refuse it, and record the outcome on both sides' history. The settlement is an agreement between you, not a decision by us.
7. Abuse and content reports
This is a completely different path from section 6, and here we do act: threats, abuse, harassment, impersonation, prohibited content. You can report any user or content from inside the app, and block anyone who is bothering you. We review the report and take action, up to permanently suspending the account.
8. What may not be traded
- Alcohol, tobacco to anyone under the legal age, prescription medicines, and narcotics.
- Weapons, ammunition, and explosive or flammable materials.
- Counterfeit or stolen goods, and anything whose trade is prohibited in Iraq.
- Live animals, and hazardous medical materials.
- Using the app to harvest other people's data, or to send unsolicited commercial messages.
9. Suspension
We may suspend or end an account for breach of these terms, or on reasonable suspicion of fraud or of danger to others. We state the reason when we suspend, and you can appeal at [email protected] — except where the suspension is immediately necessary to protect someone.
You can end your account whenever you like: delete your account.
10. Limits of our responsibility
We provide the service as it is, and we work to keep it running, but we do not guarantee it will never be interrupted. Because we are not a party to the sale or to the carriage, we are not responsible for the quality of goods, for road accidents, or for users' conduct. None of this removes any liability that Iraqi law does not permit to be removed.
11. Changes to these terms
We may update these terms. On a material change we notify you in the app before it takes effect, and continuing to use the service afterwards means you accept it.
12. Law and jurisdiction
These terms are governed by Iraqi law, and the courts of Baghdad have jurisdiction over any dispute.
